Reservation terms for guests
Version:
Translation — the German version is binding. German version →
These terms apply when you book a table at a restaurant through RunMyHub: on the restaurant’s booking page, through Google, in the restaurant’s WhatsApp chat or through an AI assistant. They govern the use of the booking system and describe how a reservation works. The German version is binding; this translation is for information.
1. Provider and contracting parties
- The booking system is operated by HS-Soft AG, Hinterbergstrasse 16, 6312 Steinhausen, Switzerland (“HS-Soft”), under the names RunMyHub and RunMyResto, on behalf of the restaurant. Email: info@hssoft.com, commercial register of the Canton of Zug, UID CHE-113.971.155.
- You make the reservation contract with the restaurant. HS-Soft does not become a party to it; it only provides the booking system to the restaurant.
- What the restaurant sets for your reservation, for example a fee, a deposit or the period for free cancellation, is shown to you before you book.
- Using the booking system is free of charge for guests.
2. How a reservation is made
- You choose the day, the number of people and the time, and give your name and contact details. Please give contact details at which the restaurant can reach you.
- Depending on the restaurant’s settings, your reservation is confirmed at once, or it is a request that the restaurant confirms or declines. A request is binding only once the restaurant confirms it. What applies is shown after you submit (“Confirmed” or “Request sent”) and in the email you receive.
- From a group size the restaurant sets, a reservation is always a request to the restaurant’s team. For groups larger than the restaurant accepts online, please contact the restaurant directly.
- If a time is fully booked, the booking system suggests the nearest free times. If the restaurant keeps a waitlist, you can put yourself on it. A waitlist entry is not yet a reservation and holds no seat for you; the table is reserved only once the restaurant confirms the entry.
- In the restaurant’s WhatsApp chat, an AI assistant answers on the restaurant’s behalf; it says so at the start of the conversation. Before it books or cancels a reservation, it shows you the details and waits for your confirmation.
3. Changes and cancellation
- If you booked on the booking page, the email contains a personal link. With it you can view your reservation, change the time or the number of people, and cancel it. A change is possible if the new time is free and meets the restaurant’s rules, for example the minimum notice.
- You can cancel online up to your visit. Whether this costs anything depends on the period for free cancellation that was shown to you before you booked (section 4).
- You change or cancel a reservation made through Google in Google, and one made in the WhatsApp chat in the chat. You change a reservation made by phone with the restaurant.
- If the restaurant changes or cancels your reservation, it usually informs you by email or WhatsApp.
4. Card guarantee, no-show fee and deposit
- A restaurant can ask for a card guarantee or a deposit for certain reservations, for example for larger groups, on certain days or if you did not turn up before. Whether this applies to your reservation is shown before you book: the amount per person, the amount for your group and the period for free cancellation. You must expressly agree to these terms; without your agreement nothing is booked.
- You enter your card on a Stripe page, through the restaurant’s Stripe account. Your bank may ask you to confirm. Neither HS-Soft nor the restaurant sees your card number. Until the card is saved or the deposit is paid, the table is held for you for a short time (usually 30 minutes); after that it is released again and the reservation is not made.
- Card guarantee and no-show fee. With a card guarantee, your card is not charged at first. If you do not turn up, or cancel after the period for free cancellation has passed, the restaurant may charge the agreed flat fee per person, calculated for the number of people in your reservation. If you cancel within the period, no fee is charged. You may prove that the restaurant suffered no loss or a substantially smaller one. If your bank wants you to confirm a charge yourself, you receive an email with a link for it.
- Deposit. You pay a deposit when you book. It is deducted from the bill for your visit; if it is higher than the bill, the restaurant refunds the difference. If you cancel within the period for free cancellation, you get the deposit back. If you cancel later or do not turn up, the restaurant keeps the deposit; no additional no-show fee is charged in that case. If the restaurant cancels the reservation, it refunds the deposit, unless you cancelled only after the period had passed. Refunds go through Stripe to the card you paid with.
- All amounts include VAT.
- The restaurant makes charges and refunds through its own Stripe account. The money goes directly to the restaurant, not to HS-Soft. Please direct questions about a charge to the restaurant.
5. Messages
- If you gave an email address, you receive by email an acknowledgement of your request, the confirmation of your reservation and messages about changes and cancellations.
- Before your visit, the restaurant may remind you of your reservation: by email, by SMS if the restaurant has switched on SMS reminders, or by WhatsApp.
- You receive WhatsApp messages only if you agreed to them or booked in the restaurant’s WhatsApp chat. You can withdraw your agreement at any time with the restaurant.
6. Reservations through Google
- If you book through Google, for example in Google Maps or Google Search (“Reserve with Google”), Google passes your reservation to HS-Soft, and HS-Soft forwards it to the restaurant. These terms apply, and for your use of Google, Google’s Terms of Service apply in addition.
- When the restaurant confirms, moves, cancels or declines your reservation, HS-Soft reports the new status to Google so that you can see it there.
- Reservations through Google currently require neither a card guarantee nor a deposit.
7. Liability
- HS-Soft provides the booking system. The restaurant alone is responsible for its services, that is the table, food, drinks and service, and for the fees and deposits it asks for.
- HS-Soft operates the booking system with care but cannot guarantee that it is available at all times. If it is not available, please contact the restaurant directly.
- HS-Soft is liable for damage it causes intentionally or through gross negligence. Otherwise, HS-Soft’s liability is excluded as far as the law permits. Mandatory statutory liability, in particular for injury to life, body or health, remains unaffected.
- HS-Soft is not liable for disruptions outside its control, in particular of the internet, your device or third-party services such as Google, WhatsApp or Stripe.
8. Data protection
The restaurant is the controller of your reservation data; HS-Soft processes it on the restaurant’s behalf. Which data this is, how long it is kept and whom to contact with questions is set out in section 10 of our Privacy Policy.
9. Changes to these terms
HS-Soft may change these terms. A reservation is governed by the version published on this page at the time of booking.
10. Final provisions
- These terms are governed by Swiss law. Mandatory provisions protecting consumers, in particular those of the country in which you live, remain unaffected.
- The place of jurisdiction is the seat of HS-Soft AG in Steinhausen ZG, Switzerland. Mandatory places of jurisdiction for consumers, in particular at your place of residence, remain reserved.
- If a provision is invalid, the rest remains valid.
- The German version is binding; translations are for information.
